Liens
Workers of all classes have property rights in
their work which subjects the owner to compulsory payment. This
applies to Artisans, Mechanics and Materialmen, Laborers and Workers.
Texas Constitution, Art. 37, Sec. 16. This secures payment by
allowing foreclosure. These property interests are known as liens.
There are two types of recognized liens, constitutional liens
and statutory liens. There is a complex scheme in place to protect
interests for both owners and workers. They are everywhere you
go. The cleaners has a lien on your clothes until you pay for
them. The auto repair shop typically will require payment prior
to giving you the keys to your car. Workers on construction projects
have a lien on the project for their wages, and so on.
