Child Support


We make parents responsible for the well-being and support of their children. Once child support is ordered, it is mandatory and wages may be garnished. Garnishment of wages means that the employer withholds wages and pays them to the person entitled to receive the child support. Child support is the only non-tax reason for garnishment of wages in Texas. Likewise, a judgment for child support is non-dischargeable in bankruptcy in Federal court.

Additional penalties for failure to pay child support include forfeiture of a driver's license and other professional licenses. Supporting children so they do not end up on welfare is a very serious matter and deserves serious attention. Occasionally a good faith dispute regarding paternity arises. In such an event, if child support was ordered without a DNA test, the obligor (person who owes the child support) may be able to dispute the paternal finding and undo the support.
